Consultation is important for calculating business costs. Often, new entrepreneurs do not take into account customs payments and other expenses related to importing goods, which increases the risks of project unprofitability.
All commercial international contracts are registered according to PCM No. 283 dated 14.05.2020 in the EEISVO (Unified Electronic Information System of Foreign Trade Operations). Without contract registration, import/export is impossible.
According to Article 297 of the TC, tariff benefits in the form of exemption from customs duties are provided for technological equipment imported into the customs territory, according to the list approved in accordance with the legislation, as well as for components and spare parts provided that their supply is stipulated by the contract (agreement) for the supply of technological equipment. Paragraph 6 of Article 246 of the Tax Code of the Republic of Uzbekistan exempts from VAT the import of technological equipment whose analogs are not produced in Uzbekistan, imported into Uzbekistan according to the approved list. Since the list of technological equipment whose analogs are not produced in Uzbekistan, exempted from VAT and import customs duties, has not been approved to date, the Government's decision has extended the exemption provided for in paragraph 6 of Article 246 of the Tax Code to the technological equipment included in the List approved by the Ministry of Justice reg. No. 2436 dated March 20, 2013 (hereinafter – the List), until the list of technological equipment whose analogs are not produced in Uzbekistan is approved. The conditions for providing customs benefits for goods included in the List are specified in the notes to it.
For customs clearance of medical equipment or medical devices, it is necessary to provide a Registration Certificate issued by the State Unitary Enterprise “CENTER FOR PHARMACEUTICAL PRODUCTS SAFETY” UNDER THE MINISTRY OF HEALTHCARE OF THE REPUBLIC OF UZBEKISTAN, valid for 5 years.
The maximum limits for importing goods into the Republic that are not subject to customs duties, received by an individual in international courier shipments, are set at 1000 (one thousand) US dollars per calendar quarter. For goods received by an individual in international postal shipments, this quota is 100 (one hundred) US dollars. It should be noted that when determining the purpose of goods being moved across the customs border by individuals, the quantity of goods is taken into account, where homogeneous goods exceeding the needs of the individual moving the goods and members of their family are considered goods imported for use in entrepreneurial activities, unless the individual moving the goods proves otherwise.
– Customs duty at the rate established by the Presidential Decree «On Additional Measures for the Regulation of Foreign Economic Activity»; – Excise tax (on excisable goods) at the rate provided by Appendix No. 13-2 to the Presidential Decree «On the Forecast of Main Macroeconomic Indicators and Parameters of the State Budget of the Republic of Uzbekistan for 2015»; – VAT – 12% of the taxable base; According to Article 206 of the Tax Code, the taxable base for the import of goods includes the customs value of the goods, as well as the amount of excise tax and customs duty payable upon import of goods into the Republic of Uzbekistan. – Customs clearance fee – 0.2% of the customs value of the goods, but not less than 25 and not more than 3,000 USD (KM Decree «On Customs Duty Rates»).
